工厂上班辞职了不发工资怎么办?？

法律分析：
按新劳动合同法的规定,只要提前一个月书面辞职,有送达用人单位,那么即视为已提前三十天书面通知,即使到时,领导没批,那么合同既自然终止,用人单位必须结算工资给你,不能克扣工资或不发工资,也不能说你自动离职。
法律依据：
《工资支付暂行规定》 第九条 劳动关系双方依法解除或终止劳动合同时，用人单位应在解除或终止劳动合同时一次付清劳动者工资。
