释义	建筑物或者其他设施以及建筑物上的搁置物、悬挂物发生倒塌、脱落、坠落造成他人人身损害，它的所有人或者管理人不能证明自己无过错的；应责令其承担民事责任所有人或管理人能够证明建筑或者其他设施的塌落花流水是设计或施工的原因造成的，其承担民事责任后有权向设计人或施工人追偿。《侵权责任法》第八十七条：从建筑物中抛掷物品或者从建筑物上坠落的物品造成他人损害；难以确定具体侵权人的，除能够证明自己不是侵权人的外，由可能加害的建筑物使用人给予补偿。
