律师解答：
1如果分家协议所涉的财产为父母所有、或是父母与二个儿子的共同财产的，则分家协议应该由父母和二个儿子一起签字才有效。
2如果所涉财产中还有第三人的财产的，则虽然有父母和两个儿子一起签字，但对于侵犯第三人财产权的部分无效，其它部分是有效的。
3如果所分财产为二个儿子的共同财产，与父母或其他人无关的，则由二个儿子签字即可，不一定需要父母一起签字。

《中华人民共和国民法典》第二百四十条 所有权人对自己的不动产或者动产，依法享有占有、使用、收益和处分的权利。
