释义	法律分析：在农村自家空地上盖猪棚算违章建筑。根据《城乡规划法》的规定,一切建筑物都应该先进行审批,否则,就是违法建筑。农村建设猪棚必须符合城乡规划,如果没有经当地乡镇人民政府批准,就是违法建筑。法律依据：《中华人民共和国行政强制法》第四十四条即便认定申请人的猪棚是违建，也要在经过60日的复议期限或者6个月的起诉期限后方可强制拆除。未办理申办用地和建房审批手续，但不违反我国的城乡整体规划的，可以补办手续。对于不符合规划的，可以修正建筑直到符合为止，经过有关部门审核后，也可以认定合法。
