释义	旅游合同免责条款如果是旅行社单方出具的格式合同作出的对旅游者不公平、不合理的规定，减轻或免除其损害旅游者合法权益的责任的，该免责条款是无效的。违反法律或者行政法规的强制性规定、违背公序良俗、恶意串通损害他人合法权益的合同无效。根据《民法典》第五百零六条规定，合同中的下列免责条款无效：（一）造成对方人身损害的；（二）因故意或者重大过失造成对方财产损失的。法律依据：《民法典》第五百零六条合同中的下列免责条款无效：（一）造成对方人身损害的；（二）因故意或者重大过失造成对方财产损失的。
