《中华人民共和国农村土地承包法》 第六十一条 国家机关及其工作人员有利用职权干涉农村土地承包，变更、解除承包合同，干涉承包方依法享有的生产经营自主权，或者强迫、阻碍承包方进行土地承包经营权流转等侵害土地承包经营权的行为，给承包方造成损失的，应当承担损害赔偿等责任；情节严重的，由上级机关或者所在单位给予直接责任人员行政处分；构成犯罪的，依法追究刑事责任。
