离婚时，一方隐藏、转移、变卖、毁损夫妻共同财产，或伪造债务企图侵占另一方财产的，分割夫妻共同财产时，对隐藏、转移、变卖、毁损夫妻共同财产或伪造债务的一方，可以少分或不分。离婚后，另一方发现有上述行为的，可以向人民法院提起诉讼，请求再次分割夫妻共同财产。离婚时，个人财产归个人，而夫妻共同财产则要进行分割。一方存在隐藏、转移、变卖、毁损夫妻共同财产，或伪造债务企图侵占另一方财产行为的，分割夫妻共同财产时可以少分或不分;此外，如果一方离婚后才发现另一方隐藏了财产，则不管离婚多长时间，都可以在发现之日起2年内提起分割隐藏财产的诉讼。1、及时制止，聘请律师协助发觉夫妻关系即将破裂，为防止一方转移财产，应该共同清理汇总夫妻共同财产数目。若发现一方擅自处理财产，另一方要及时制止，必要时要尽快聘请律师协助处理。2、申请财产保全提起离婚诉讼前发现对方已在转移、变卖、毁损财产等，可以向法院申请诉前财产保全。需要提醒的是在法院采取保全措施后三十日之内，申请人必须起诉，如果不起诉，法院将解除财产保全。离婚诉讼中，发现对方有毁损、隐匿、转移、变卖财产等迹象时，可以向法院申请财产保全。法院采取财产保全措施后，负有保管被保全财产的义务人必须妥善保管，不得隐藏、转移、毁损或变卖财产。3、离婚后再分割在离婚后，一方又找到另一方离婚前转移财产的证据，还可以向人民法院提起诉讼，请求再次分割夫妻共同财产。
