1、依据《城市房屋租赁管理办法》第六条规定，有下列情形之一的房屋不得出租：（1）未依法取得房屋所有权证的;（2）司法机关和行政机关依法裁定、决定查封或者以其他形式限制房地权利的;（3）共有房屋未取得共有人同意的;（4）权属有争议的;（5）属于违法建筑的;（6）不符合安全标准的;（7）已抵押，未经抵押权人同意的;（8）不符合公安、环保、卫生等主管部门有关规定的;（9）有关法律、法规规定禁止出租的其他情形。2、根据《商品房屋租赁管理办法》第六条规定，有下列情形之一的房屋不得出租：(1)属于违法建筑的;(2)不符合安全、防灾等工程建设强制性标准的;(3)违反规定改变房屋使用性质的;(4)法律、法规规定禁止出租的其他情形。法律依据：《城市房屋租赁管理办法》第六条有下列情形之一的房屋不得出租：(一)未依法取得房屋所有权证的;(二)司法机关和行政机关依法裁定、决定查封或者以其他形式限制房地产权利的;(三)共有房屋未取得共有人同意的;(四)权属有争议的;(五)属于违法建筑的;(六)不符合安全标准的;(七)已抵押，未经抵押权人同意的;(八)不符合公安、环保、卫生等主管部门有关规定的;(九)有关法律、法规规定禁止出租的其他情形。
