释义	法律分析：一般不可以的。在还保留学生身份之前，公司与之建立的都不是劳动关系，只是劳务关系，符合雇佣关系特征的，可以认定为雇佣关系。还没拿到毕业证的仍然属于在校生,不具备劳动法中签订劳动合同的主体资格，因此还没拿到毕业证的应届生签订的是就业协议书。法律依据：《关于贯彻执行〈中华人民共和国劳动法〉若干问题的意见》第十二条在校生利用业余时间勤工助学，不视为就业，未建立劳动关系，可以不签订劳动合同。
