夫妻一方出轨就一定能得到赔偿吗？ |

夫妻一方出轨不一定能获得赔偿，出轨不等同于与他人同居或者重婚。有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：
1.重婚的；
2.有配偶者与他人同居的；
3.实施家庭暴力的；
4.虐待、遗弃家庭成员的。
一、离婚有没有精神出轨这一理由
离婚没有精神出轨这一理由。有下列情形之一，调解无效的，应准予离婚：
1.重婚或有配偶者与他人同居的；
2.实施家庭暴力或虐待、遗弃家庭成员的；
3.有赌博、吸毒等恶习屡教不改的；
4.因感情不和分居满二年的；
5.其他导致夫妻感情破裂的情形。
二、婚姻存续期间一方出轨财产如何分
婚姻关系存续期间一方出轨的，离婚时，夫妻的共同财产由双方协议处理；协议不成时，由人民法院根据财产的具体情况，照顾子女和女方权益的原则判决。一方如果有下列情形之一的，无过错方有权请求损害赔偿：1.重婚；2.与他人同居；3.实施家庭暴力；5.虐待、遗弃家庭成员；5.有其他重大过错。
三、婚内一方出轨是否违法
夫妻一方婚内出轨不是违法。我国法律并不规范出轨行为。根据相关法律规定，夫妻一方在婚姻存续期间，存在重婚、与他人同居、实施家庭暴力、虐待或遗弃家庭成员等重大过错，导致离婚的，无过错方有权请求物质损害赔偿和精神损害赔偿。
