《企业劳动争议处理条例》 第六条 劳动争议发生后，当事人应当协商解决；不愿协商或者协商不成的，可以向本企业劳动争议调解委员会申请调解；调解不成的，可以向劳动争议仲裁委员会申请仲裁。
