释义	法律分析：（一）本金的处理借贷合同被确认无效后，借款人从贷款人处取得的借款本金应当向贷款人返还。（二）利息的处理我国法律没有对借款合同被确认无效后利息如何处理作出明确的规定。而实践中，对无效借款合同项下的利息处理一直都是沿用：除本金可以返还外，对出资方已经取得或者约定取得的利息应予收缴，对另一方则应处以相当于银行利息的罚款。法律依据：《中华人民共和国民法典》第一百五十六条民事法律行为部分无效，不影响其他部分效力的，其他部分仍然有效。
