释义	处理民间借贷纠纷一般应遵循下列原则：（一）人民法院审查借贷纠纷案件的起诉时，要求原告提供书面借据；无书面借据或无法提供的，应提供必要的事实根据或与自己无利害关系的两人以上的证人证言，来支持自己的主张。（二）民间借贷的利率可以适当高于银行利率，但最高不得超过合同成立时一年期贷款市场报价利率的四倍，超出部分的利息依法不予以保护。【本文关联的相关法律依据】《民法典》第六百六十七条，借款合同是借款人向贷款人借款，到期返还借款并支付利息的合同。
