辞职单交上去不给批怎么办

法律主观：

辞职但是用人单位不给辞职单的，员工可以与其进行协商，经协商一致的可以解除合同。但是即使不能协商一致，员工也可以提前三十天以书面形式通知单位解除合同，在三十天满后可以自行离职。

法律客观：

《劳动合同法》第三十七条，劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
