释义	法律分析: 诉讼费不包括律师费，部分合同中约定了律师费由败诉方承担的，可向对方主张律师费。法律依据: 《诉讼费用交纳办法》第六条诉讼费用包括案件受理费、申请费和证人、鉴定人、翻译人员、理算人员在法院指定的日期出庭而发生的交通费、住宿费、生活费和误工补贴。显然，诉讼费不包括律师费。同时，诉讼费是法院收取的，而律师费是律师(事务所)收取的，所以诉讼费也不可能包括律师费。诉讼费由败诉方承担，但律师费一般是由委托方承担，除非有法律规定或者合同约定。
