法律分析：
单纯的放高利贷行为不会触犯刑法，我国相关法律规定，超过银行贷款利息三倍的借贷不受法律保护；但是如果强行讨要的话可能会触犯刑法，例如为索取高利贷、赌债等法律不予保护的债务，非法拘禁他人。这样的行为是会受到刑法的约束。
法律依据：
《中华人民共和国民法典》 第六百六十七条 借款合同是借款人向贷款人借款，到期返还借款并支付利息的合同。
