释义	法律分析：必须去被告住所地或是事故发生地。所以当事人所发生的交通事故不是在本地，而是在居住地以外的地方，那么根据上述原则，原告如果起诉，可以选择事故发生地的法院起诉，也可以选择被告住所地或居住地法院起诉。居住地是指被告离开自己的住所(户籍所在地)而在此居住超过一年的居所地。法律依据：《中华人民共和国民事诉讼法》第二十九条因铁路、公路、水上和航空事故请求损害赔偿提起的诉讼，由事故发生地或者车辆、船舶最先到达地、航空器最先降落地或者被告住所地人民法院管辖。
