释义	法律分析：知名商标被人抢注的，如果商标正在公告期的话，企业可以向商标局提出异议，从而维护自己的合法权益。商标异议无效或者是商标已经被注册成功的话，企业可以自商标注册之日起的五年内，在先权利人或者利害关系人可以请求商标评审委员会宣告该注册商标无效。法律依据：《中华人民共和国刑法》第二百一十四条销售明知是假冒注册商标的商品，销售金额数额较大的，处三年以下有期徒刑或者拘役，并处或者单处罚金；销售金额数额巨大的，处三年以上七年以下有期徒刑，并处罚金。
