释义	法律客观：《设施农用地管理规定》第二条设施农业及其附属设施用地管理坚持属地管理原则。设施农业及其附属设施用地建设要符合农业发展规划、乡级土地利用规划和乡村建设规划。设施农用地要合理选址。在保护耕地、合理利用土地的前提下，严格审批规范管理，尽量少占或不占耕地，利用荒山荒坡、滩涂等未利用地和低效闲置的土地，坚决禁止占用基本农田，禁止超规模占地，禁止搭车审批。设施农用地畜牧场、饲养场、水产养殖场，确需占用耕地的，须签订复耕保证书，交纳复垦保证金，按时要求恢复成耕地。
