释义	1、聚众赌博要处三年以下有期徒刑、拘役或者管制，并处罚金。行为人设置圈套诱骗他人参赌获取钱财，属赌博行为，构成犯罪的，应当以赌博罪定罪处罚。参赌者识破骗局要求退还所输钱财，设赌者又使用暴力或者以暴力相威胁，拒绝退还的，应以赌博罪从重处罚。但行为人虽然提供赌场、赌具，本人未从中渔利的，不能认定赌博罪。 2、法律依据：《中华人民共和国刑法》第三百零三条，以营利为目的，聚众赌博、开设赌场或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。
