释义	法律分析：只要具备下列形式要件和实质要件，即可认定为雇佣关系。一、从形式要件上：看双方有无订立雇佣合同或口头雇佣协议。二、从实质要件上：首先要看双方的权力义务是否为一方提供劳务，另一方支付报酬。其次要看雇员是否受雇主控制、指挥和监督，即是否存在隶属关系。三是看雇员是否为雇主或其委托的人所选任。法律依据：《中华人民共和国民法典》第七百七十条承揽合同是承揽人按照定作人的要求完成工作，交付工作成果，定作人支付报酬的合同。承揽包括加工、定作、修理、复制、测试、检验等工作。
