释义	法律分析: 刑事申诉是指对人民检察院诉讼终结的刑事处理决定以及对人民法院已经发生法律效力的刑事判决、裁定（含刑事附带民事判决、裁定）不服的申诉。具有刑事申诉主体资格的是原案当事人及其法定代理人、近亲属；受委托的律师也可以代理申诉。申诉权是我国宪法赋予公民的一项基本权利。《中华人民共和国刑事诉讼法》第二百五十二条当事人及其法定代理人、近亲属，对已经发生法律效力的判决、裁定，可以向人民法院或者人民检察院提出申诉，但是不能停止判决、裁定的执行。
