释义	法律分析：工资按小时计算是合法的，用人单位工资分配遵循按劳分配原则，实行同工同酬和最低工资保护制度，依法自主确定本单位工资分配形式和水平。全日制职工工资分配可以实行小时工资分配办法。工资必须在用人单位与劳动者约定的日期支付。如遇节假日或休息日，则应提前在最近的工作日支付。工资至少每月支付一次，实行周、日、小时工资制的可按周、日、小时支付工资。法律依据：《劳动法》第四十七条，用人单位根据本单位的生产经营特点和经济效益，依法自主确定本单位的工资分配方式和工资水平。
