释义	律师解析：具体情况具体分析。如果是在购房合同没有做预售登记前丢失的，只需将剩余的合同作废，和开发商重新签订一份合同；如果是在购房合同做完预售登记，没有开始办理银行按揭前丢失的，应在报纸上刊登声明合同作废，到期满后，拿着报纸去做预售登记的机关申请注销所签订的那份合同，然后和开发商重新签订一份合同，再去做预售登记。如果是在做完预售登记，已经办理好银行按揭手续后丢失的，则购房者除需要办理第二种情况所办理的手续外，购房者还要和办理贷款的银行签订一份变更协议，并将新的合同放在银行，因为原先的购房合同已经注销了，换成新的合同，也就是说购房者和银行所签的借款合同里的合同号已经发生变化了，尽管购房合同里面的内容没有发生变化，但依据《合同法》规定，该借款合同已经发生变更，所以需和银行签订变更合同。【法律依据】：《中华人民共和国城市房地产管理法》第六十条国家实行土地使用权和房屋所有权登记发证制度。
