问题	有抵押贷款的房产法院要如何拍卖
释义	已经抵押的房产仍然是可以查封的，但不影响抵押权人行使权利。最高人民法院《关于适用中华人民共和国担保法若干问题的解释》第五十五条规定：已经设定抵押的财产被采取查封、扣押等财产保全或者执行措施的，不影响抵押权的效力。因此，有一些已设定抵押的房地产、如果担保的债权数额较大，在拍卖该房产后可能无剩余的，人民法院就不再对该房产进行查封。已经查封的房屋不应再设定抵押。因为查封某一房产，应应当禁止对该房产进行处分。人民法院也只承认该房产在被采取查封、扣押之前已经设定的抵押权的效力。
