房子没到期退租不给押金怎么办

释义

法律主观：

具体可以双方协商解决。但是租房合同没有到期而解除合同，提出解除方要按照合同约定承担违约责任，押金一般不予退还。《民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。

《城市房屋租赁管理办法》第十条规定，房屋租赁期限届满，租赁合同终止。承租人需要继续租用的。应当在租赁期限届满前3 个月提出，并经出租同意，重新签订租赁合同。
