释义	法律分析：因工程损害导致第三方人员伤亡和财产损失由发包方承担,不是因工程损害导致第三方人员伤亡和财产损失由谁承担，如发生不可抗力时有外来人员进入，此时工程本身也没有损害法律依据：《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》第十一条与用人单位具有合法劳动关系的劳动者在劳动过程中遭受人身损害的，用人单位应当承担赔偿责任。劳动关系以外的第三人造成劳动者人身损害的，赔偿权利人可以请求该第三人或者用人单位承担赔偿责任。
