释义	口头承诺有法律效力，法律规定民事法律行为可以采用书面形式、口头形式或其它形式。只要法律没有明确规定不惜采用书面形式的，一般口头承诺都有法律效力。但是口头承诺往往难以举证。如果有录音或录像、知情人证明等证明口头承诺的内容的，可以起诉到法院请求履行原承诺。法律依据：《中华人民共和国民法典》第一百三十五条　民事法律行为可以采用书面形式、口头形式或者其他形式；法律、行政法规规定或者当事人约定采用特定形式的，应当采用特定形式。
