释义
盗用他人的专利如果情节严重的，是有可能构成犯罪的，按假冒专利罪追究当事人的刑事责任。
法律依据:
《中华人民共和国专利法》 第六十三条 假冒专利的，除依法承担民事责任外，由管理专利工作的部门责令改正并予公告，没收违法所得，可以并处违法所得四倍以下的罚款;没有违法所得的，可以处二十万元以下的罚款历锋;构启碧成犯罪的，依法追究刑事责任。
《中华人民共和国刑法》 第二百一十六条 假冒他人专利，情节严重的，悄烂举处三年以下有期徒刑或者拘役，并处或者单处罚金。
