建设单位有权利对施工单位进行罚款吗 -法律知识

法律分析：
无权，建筑工地罚款不合法，罚款属于行政处罚的一个种类，因此，有权罚款的机关只能是行政执法部门，有权作出罚款处罚的机关及其罚款的限额和罚款的程序等进行了严格的规定，作为工程的发包方，不具有行政执法部门的职能，无权对承包方进行罚款。
法律依据：
《中华人民共和国行政处罚法》 第三条 公民、法人或者其他组织违反行政管理秩序的行为，应当给予行政处罚的，依照本法由法律、法规或者规章规定，并由行政机关依照本法规定的程序实施。没有法定依据或者不遵守法定程序的，行政处罚无效。
