问题	新婚姻法关于婚前财产的规定
释义	众所周知，婚前个人财产特别是婚前房产，如果没有约定，过去的司法解释曾有婚姻关系存续八年后作为夫妻共同财产的规定。因而导致有些夫妻在婚前进行“婚前财产公证”，以明确各自婚前财产的处理。民法典生效后，规定婚前财产如果要作为“共同财产”，双方必须约定。这就实际上肯定、明确了婚前个人财产不作为共同财产的处理原则。因此，新的司法解释就规定，婚前个人财产不因为婚姻的存续转化为共同财产。这实际上就取消了“婚姻存续八年，婚前个人财产(房产)作为共同财产”的规定。
