释义	法律分析：用人单位应当与劳动者订立书面劳动合同，而不应根据自身的需求随意与劳动者订立所谓的劳务合同、雇佣合同等。这样的做法并不能推卸用工责任，也不能规避用工风险。即使与劳动者签订非格式劳动合同，也应当符合劳动法律、法规的规定。法律依据：《中华人民共和国劳动合同法》第七十一条建立劳动关系应当订立书面劳动合同;用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付两倍的工资”的规定，
