法律依据：
《中华人民共和国刑诉法》 第八十一条 对有证据证明有犯罪事实，可以判处徒刑以上刑罚的犯罪嫌疑人、被告人，采取取保候审、监视居住等方法，尚不足以防止发生社会危险性，而有逮捕必要的，应即依法逮捕。据此，逮捕应具备三个条件：(一)有证据证明有犯罪事实。这是逮捕的前提和基本条件。逮捕通常不是在侦查终结以后才采取，而是逮捕之后仍将继续进行侦查，所以，经过初步侦查，只要有证据证明发生了犯罪事实且是该犯罪嫌疑人、被告人实施了犯罪，便可对其执行逮捕。(二)可能判处有期徒刑以上的刑罚。这就是说， 犯罪嫌疑人、被告人，所犯的罪，按照刑法的规定，可以判处有期徒刑以上的刑罚。(三)采取取保候审、监视居住等强制措施，还不足以防止其发生社会危险性。所谓“社会危险性”是指犯罪嫌疑人、被告人，可能有逃跑、自杀、串供、毁灭罪证等妨碍诉讼活动进行的情况以及可能行凶报复继续进行犯罪活动，给社会带来新的危害。
