法律分析：违法。公司违法，可以向公司所在地劳动仲裁委员会申请劳动仲裁。要求支付工资及经济补偿金。公司可以以严重违反劳动纪律和公司规章制度为由解除劳动合同，但必须调查核实，并以规定的程序作出处理认定，并告知。
法律依据：《中华人民共和国劳动法》 第八十九条 用人单位制定的劳动规章制度违反法律、法规规定的，由劳动行政部门给予警告，责令改正；对劳动者造成损害的，应当承担赔偿责任。
