释义	法律分析：买卖合同没有明确约定定金为解约定金的，就不能视为解约定金，任何一方不得以放弃或双倍返还定金为代价解除买卖合同。原则上定金与违约金是不能并用的，但解约定金可以和违约金同时并用。法律依据：北京高院《关于审理买卖合同纠纷的指导意见》当事人同时约定违约金和定金并约定了定金性质的，当事人一方违约，对方依据约定的定金性质一并主张违约定金和违约金的，法院不予支持;当事人一方违约，对方依据约定的定金性质一并主张解约定金和违约金的，法院应予支持。
