释义	法律分析：共同犯罪的分类，从结构上来看，可分为两类。1、任意共犯：一人能单独实施的犯罪由二人共同实施的情形。如盗窃罪，一人可以实施，二人三人也可共同实施。2、必要共同犯罪：由二人以共同实施才能完成的犯罪。如聚众持械劫狱罪，重婚罪。从作用上来看，共同犯罪分为主犯，从犯，胁从犯。从分工上来看，共同犯罪分为帮助犯，教唆犯，实行犯。法律依据：《中华人民共和国刑法》第二十七条在共同犯罪中起次要或者辅助作用的，是从犯。对于从犯，应当从轻、减轻处罚或者免除处罚。
