释义	按照新修订的《营业税暂行条例》及其《实施细则》，从今年1月起，我市二手房赠与将不再免征营业税。据国务院、财政部和国家税务总局重新颁布的《营业税暂行条例》及其《实施细则》规定：单位或者个人将不动产或者土地使用权无偿赠送其他单位或者个人的，视同发生应税行为。因此，我市市民在进行二手房交易时，赠与同交易一样征收营业税。两年以下征收5.55%的营业税及其附加。专业人士认为，这将从政策层面堵塞虚假赠与产生的税收漏洞，假赠与的现象将得到有效遏制。
