释义	国有企业人员失职罪构成既遂判处三年以下有期徒刑或者拘役。本罪属结果犯，徇私舞弊行为，只有造成国有公司、企业破产或者严重亏损，致使国家利益遭受重大损失时，才构成犯罪。【法律依据】《刑法》第一百六十八条第一款国有公司、企业直接负责的主管人员，徇私舞弊，造成国有公司、企业破产或者严重亏损，致使国家利益遭受重大损失的，处三年以下有期徒刑或者拘役。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
