释义	如果是商业合同，在合同履行完毕的情况下，对方不退保证金，则可以向法院起诉;如果是劳动合同，根据劳动合同法的规定是不能收取保证金的，建态迹议向劳动监察部门投诉。法律依据：《中华人民共和国埋枝民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救方法或者赔偿损失等违约责任。《中华人民共和国劳动合同法》第九条用人单位招用劳动者，不得扣押劳动者的帆液并居民身份证和其他证件，不得要求劳动者提供担保或者以其他名义向劳动者收取财物。
