释义	间谍罪的量刑幅度是一般应当处十年以上有期徒刑或者无期徒刑；情节较轻的，处三年以上十年以下有期徒刑。本罪是行为犯，并不以实际上发生法定的危害结果作为犯罪成立的要件，只要实施了间谍行为，就构成本罪，就应当立案追诉。法律依据《刑法》第一百一十条，为境外的机构、组织、人员窃取、刺探、收买、非法提供国家秘密或者情报的，处五年以上十年以下有期徒刑；情节特别严重的，处十年以上有期徒刑或者无期徒刑；情节较轻的，处五年以下有期徒刑、拘役、管制或者剥夺政治权利。
