用人单位未签订劳动合同，劳动者可以向当地劳动监察大队投诉，没有劳动合同劳动局是管的。没有劳动合同的，可以搜集并提供作证或工作牌等证明存在劳动关系。然后就去劳动局申请仲裁

《中华人民共和国劳动争议调解仲裁法》 第九条 用人单位违反国家规定，拖欠或者未足额支付劳动报酬，或者拖欠工伤医疗费、经济补偿或者赔偿金的，劳动者可以向劳动行政部门投诉，劳动行政部门应当依法处理。
