释义	法律分析：法律上的周岁从周岁生日的第二天起算。现实中，由于多种原因导致劳动者的档案年龄与身份证年龄不一致。依据相关法律规定，自然人的出生时间和死亡时间，以出生证明、死亡证明记载的时间为准；没有出生证明、死亡证明的，以户籍登记或者其他有效身份登记记载的时间为准。有其他证据足以推翻以上记载时间的，以该证据证明的时间为准。法律依据：《最高人民法院关于审理未成年人刑事案件具体应用法律若干问题的解释》第二条　刑法第十七条规定的“周岁”，按照公历的年、月、日计算，从周岁生日的第二天起算。
