释义	法律分析: 个人是不能承揽建筑工程施工分包工程业务的。建设单位将工程发包、分包给个人是违法行为。按照规定将工程发包给不具有相应资质等级的施工单位的，将处以50万元以上100万元以下罚款。法律依据: 《中华人民共和国建筑法》第二十九条建筑工程总承包单位可以将承包工程中的部分工程发包给具有相应资质条件的分包单位是，除总承包合同中约定的分包外，必须经建设单位认可。施工总承包的，建筑工程主体结构的施工必须由总承包单位自行完成。
