释义	首付分期买房可能违法。首付分期涉嫌开发商垫资、融资，避银行按揭贷款对首付款要求、违反按揭贷款相关规定等违法违规行为，使缺乏资质的人取得贷款，变相突破住房信贷政策。法律依据: 《中华人民共和国商业银行法》第三十九条关于资产负债比例管理的有关规定。第四十条关于不得向关系人发放信用贷款、向关系人发放担保贷款的条件不得优于其他借款人同类贷款条件的规定。不得给委托人垫付资金，国家另有规定的除外。严格控制信用贷款，积极推广担保贷款。
