释义	法律分析：所谓空股股权，即通常所说的未缴付资本的股权。在授权资本制度下，未缴付资本的空股股权并非不正常的公司法律现象。而在实收资本制度下，就法律而言原本应无空股股权之说，但实践中因虚假出资或抽逃资本引发的空股股权现象屡见不鲜，屡禁不止。法律依据：《中华人民共和国公司法》第三条公司是企业法人，有独立的法人财产，享有法人财产权。公司以其全部财产对公司的债务承担责任。
