释义	法律分析：买东西交了定金不一定要买，但是如果不买东西了，交付的定金是不能退的。因为定金具有担保合同履行的功能，买方不买东西，构成违约，按照法律规定，卖方有权不退还已经交付的定金，这是买方违约应当承受的代价。法律依据：《中华人民共和国民法典》第五百八十七条　债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金；收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
